The Review Officer must first consider the available information and then determine the issues under review and the method by which the review will be conducted. There are three methods:
(a)
Read and review. This involves the Review Officer reading the WorkSafeBC file together with any written submissions from the parties to the review. This is the method that will be used in most cases. |
(b)
Read and review with additional inquiries. In addition to the read and review, the Review Officer may request additional information from a party, a member of WorkSafeBC's staff or a person outside WorkSafeBC who is a witness, or who is considered by the Review Officer as able to provide an expert opinion on the matter at issue. The request may be made either orally or in writing. |
(c)
Oral hearing. The Review Officer may, on his or her own initiative or at the request of a party, agree to hold an oral hearing at which the parties meet together with the Review Officer and provide oral evidence and submissions. This method will be used in exceptional cases. |
In all cases, the Review Officer will have the discretion to meet or talk to the parties for the purpose of developing a better understanding of the issues and determining the process to be followed.
The Review Officer must make a decision on a review within 150 days after WorkSafeBC receives the request for review. This general requirement is subject to some limited exceptions in complex cases discussed in 2.7 of the Practice and Procedures Manual.
